Terms and conditions for hiring 'Pedal Power' E-bicycles

The Sampige Foundation (hereinafter “the Foundation”) has been donated high quality electric bicycles under a project known as “Pedal Power” by Green Urban Mobility Innovation Living Lab (GUMILL), which is an initiative of GIZ India.   GIZ is an enterprise owned by the German Government and in coordination with Government of India, it is implementing various projects in India, which is environmentally friendly, low emission and socially balanced urban mobility systems.  This eco-friendly transportation “Pedal Power” will help reduce carbon footprints can be availed by any person above the age of 18 years, subject to acceptance of the following terms and conditions:

 

  1. The Customer agrees to provide a photocopy of his/her Aadhaar Card, or any other Government issued identification document at the time of hiring the e-bicycle from the Foundation.

  2. The Customer agrees to abide by the instructions of the Foundation for proper use of the e-bicycle, as well as user information about the electric assist technology and battery charging.

  3. The Foundation maintains the e-bicycles in a roadworthy condition.  However, it is the responsibility of the Customer to check the bicycle before operating it on any road.

  4. The Customer agrees to take care of the e-bicycle, and its accessories at all times during the hire period and accept the liability for full cost of any loss or damage to the e-bicycle and/or its components.  The e-bicycle shall be returned to the Foundation in an undamaged condition.  Undamaged condition means normal wear and tear, but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes.  The damaged parts or components will be repaired/replaced at the cost of the Customer.  The Customer agrees to pay market (MRP+taxes) rates for damaged components to be replaced.

  5. The Customer accepts liability for injury or damages caused to him/her or others whilst using the e-bicycle. 

  6. The Customer must only drive the e-bicycle within his/her own physical capabilities, the Foundation does not take any responsibility in this regard.

  7. It is recommended that the Customer wears a helmet and other safety gear and seek instructions from the Foundation Staff for the safe operation of the e-bicycle.  Helmets are provided free to all Customers which shall be returned to the Foundation alongwith the e-bicycle upon expiry of the rental period.

  8. To prevent theft, all the Foundation’s e-bicycles are provided with a lock and GPS system.   The Customer is required to lock e-bicycle every time it is left unattended.  It should be locked against an object that does not allow the same to be lifted over or off a fixture. In case of theft of the e-bicycle, the Customer shall pay the value of the e-bicycle to the Foundation.   The exact value in such case shall be Rs.________or as may be mutually agreed to between the Foundation and the Customer.

  9. The Customer is responsible for the protection of electric parts of the e-bicycle during rain or wet conditions.  By wrapping the electric parts in plastic cover, the e-bicycle can be protected from any damage due to exposure.

  10. The Customer agrees to return the e-bicycle in a clean, undamaged condition to avoid any additional fees due to repair, maintenance or replacement.

  11. Modifying or exchanging original parts of the e-bicycle will be penalized and a fee will be charged on account of replacement parts required.

  12. Once every ten days after a e-bicycle is taken on rent by the Customer, a maintenance check will be conducted by the Foundation at its premises in order to ensure that the condition of the e-bicycle is optimal, and that the Customer is meeting general requirements as stated herein.   The maintenance check will be done by the Foundation representative free of charge, failure to comply with the maintenance check will incur in the cancellation of this contract.

  13. The rental of the e-bicycle shall be Rs. 400 for  4 weeks and any extension thereafter shall be at Rs. 100 each day till the e-bicycle is returned to the Foundation. 

  14. The Customer understands that bicycling can be hazardous and can result in injury or death.  The Customer is aware of the risks, dangers and hazards associated with e-bicycle and freely accepts and fully assumes all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting therefrom.  The Customer agrees to hold harmless and indemnify the Foundation and its employees from any loss or damage, including personal injury/death or property damage related to the use of the rented e-bicycle.  

  15. The Customer hereby releases the Foundation, its owners, employees and agents from any and all liability for damage or injury to the Customer, any person, or property resulting from negligence, maintenance, and use of the e-bicycle.  The Customer accepts full responsibility for any and all such damage, injury or death which may result. 

  16. E-bicycle checklist:

  • Bicycle Lock

  • One set of keys

 

17. The courts at Bengaluru shall have exclusive jurisdiction over any disputes arising under this agreement.
